sahihNarrated Abu Huraira:
Allah's Messenger (ﷺ) said, "If a man finds his very things with a bankrupt, he has more right to take them back than anyone else."
حَدَّثَنَا أَحْمَدُ بْنُ يُونُسَ، حَدَّثَنَا زُهَيْرٌ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، قَالَ أَخْبَرَنِي أَبُو بَكْرِ بْنُ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ، أَخْبَرَهُ أَنَّ أَبَا بَكْرِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ أَخْبَرَهُ أَنَّهُ، سَمِعَ أَبَا هُرَيْرَةَ ـ رضى الله عنه ـ يَقُولُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم أَوْ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ
مَنْ أَدْرَكَ مَالَهُ بِعَيْنِهِ عِنْدَ رَجُلٍ أَوْ إِنْسَانٍ قَدْ أَفْلَسَ، فَهْوَ أَحَقُّ بِهِ مِنْ غَيْرِهِ

Islam pays significant care to preserving people's wealth, and keenly ensures that it should not be wasted. Therefore, it has enacted laws and laid down guidelines to preserve people’s wealth. In this hadeeth, the Prophet ﷺ regulated the conduct of a creditor who finds his property intact with a debtor who goes bankrupt. He ﷺ underlined that such a creditor is entitled to his own property only, and must not take anything more or less from the bankrupt debtor, because his wealth is exhausted and he cannot repay his debts. Such a creditor is more entitled to take back his property than other creditors. This means that if someone goes bankrupt, and he owed money to many creditors, his wealth (i.e., what is surplus of his needs) is to be divided among these creditors according to their debts, unless one finds his property intact and, in this case, he has more right to take it back than anyone else. .
