المسألة الرابعة والتسعون قال الخرقى: والعقيقة سنة. وبه قال أكثرهم. لما روى أحمد بإسناده عن عمرو بن شعيب عن أبيه عن جده قال «سئل رسول الله ﷺ عنالعقيقة؟ - وذكر الخبر إلى أن قال -: من ولد له منكم مولود فأحب أن ينسك عنه فليفعل». وقال أبو بكر فى التنبيه: إن سأل سائل عن العقيقة: أواجبة هى؟ قيل له: هى واجبة. والدلالة على وجوبها: ما روينا عن رسول الله ﷺ أنه قال «يعق عن الغلام شاتان، وعن الجارية شاة. لا يضركم ذكرانا كن أم إناثا» وروى عنه أنه قال «المؤمن مرتهن بعقيقته» وأن النبى ﷺ «عق عن نفسه» فالعقيقة واجبة بهذه السنن. فهذا دليل أبى بكر.
