    المسألة السادسة والخمسون قال الوالد السعيد فى المجنون: إذا كان جنونه مطبقا فى جميع الأوقات، وكان محتاجا إلى النكاح، فقال الخرقى: يجوز للولى تزويجه. لأنه محتاج إلى ذلك. وليس له إذن فى الحال. ولا يرجى له إذن فى الثانى. فجاز تزويجه بغير إذنه. وقال أبو بكر فى الخلاف: لا يجوز للأب تزويجه إذا كان بالغا. ووجهه: أنه بالغ محجورا عليه، أشبه المحجور عليه لسفه.
