    المسألة الرابعة والثلاثون قال الخرقى: ومن حج عن غيره، ولم يكن حج عن نفسه: رد ما أخذ. وكانت الحجة عن نفسه. واختارها ابن حامد. وبه قال الشافعى ووجهه: أن أكثر ما فيه عدم التعيين. وذلك غير معتبر فى الإحرام الدليل عليه: لو أحرم مطلقا انصرف إلى الفرض. كذلك إذا نواه عن غيره: يجب أن ينصرف إلى نفسه. وقال أبو بكر فى كتاب الخلاف: إن الإحرام لا ينعقد جملة. ويقع باطلا. ووجهه: أنه لم ينوه عن نفسه، ونواه عن غيره. وقد قلنا: لا ينعقد عن الغير
