١٥٣ - على بن الحسين القاضى أبو الحسن الجوزى. بضم الجيم وبزاء بعد الواو- نسبة إلى بلدة من بلاد فارس، لقى أبا بكر النيسابورى وروى عنه، وصنف "المرشد" و"الموجز على ترتيب المختصر" واختار فيه أن الزانى لا ينكح إلا مثله استدلالًا بالآية (١). وأن من زنى بعد العقد قبل الدخول انفسخ نكاحه، وأنكر أن تكون الآية منسوخة بقوله: ﴿وَأَنْكِحُوا الْأَيَامَى مِنْكُمْ﴾ (٢). وحكى فيه عن ابن حربويه أنه إذا حرم دارًا أو ثَوْبًا أو شيئًا لزمته الكفارة.
