المسألة الثالثة والثلاثون قال الخرقى: وإذا رأى الهلال نهارا، قبل الزوال أو بعده: فهو لليلة المقبلة، لأنه مروى عن على، وابن عمرو، وابن مسعود. وقال أبو بكر فى التنبيه: فإن أخبرونا عن رؤية الهلال قبل الزوال وبعده للإفطار والصيام، قيل: إذا رآه قبل الزوال فهو لأمسه. وإذا كان بعد الزوال فهو لغده. وهو مذهب الثورى وأبى يوسف. لأن عمر بن الخطاب كتب إلى سعد بن أبى وقاص وإلى أهل جلولاء «إذا رأيتم الهلال فى الصوم فى آخر النهار: فلا تفطروا. وإذا رأيتموه فى أول النهار بالأمس: فأفطروا، فإنه كان بالأمس»
