    (المَسْأَلَةُ السَّادِسَةُ والسِّتُوْنَ): قَالَ الخِرَقِيُّ: إِذَا قَال لَهَا: أَنْتِ طَالِقٌ إِذَا قَدِمَ فُلَانٌ، فَقُدِمَ بِهِ مُكْرَهًا، أَوْ مَيِّتًا: لَمْ تَطْلُقْ؛ لأنَّ القُدُوْمَ لَمْ يُوْجَدْ مِنْهُ، وإِنَّمَا قُدِمَ بِهِ. فَلِهَذَا لَمْ تَطْلُقْ لِعَدَمِ الصِّفَةِ. وَقَالَ أَبُو بَكْرٍ: إذَا قُدِمَ بِهِ مَيْتًا حَنَثَ؛ لأنَّ العَيْنَ الَّتِي عَلَّقَ الصِّفَةَ بِهَا قَدْ (¬٢) قَدِمَتْ، فَوَقَعَ الطَّلَاقُ كَمَا لَوْ قَدِمَ حَيًّا.
