    ٤٠٤ - علي (¬٢) بن مردان شاه صاحب اختيار، وتصحيح في المذهب ذكره الإمام عمر بن عبد العزيز ابن مازة في"الواقعات"فقال: قيل لرجل هذه الملفلفة أمرآتك ثم قيل له: احلف بثلاث طلقات أنه لم يكن له امرأة سوى هذه، فحلف ثلاث تطليقات أنه ليس له امرأة سوى هذه، وتلك امرأة أجنبية، قال أبو النصر: لا تطلق، وقال أبو القاسم: تطلق. قال ابن مردان شاه: جواب أبي نصر على مذهب أبي يوسف، وجواب أبي القاسم على مذهب محمد، وقال: مذهب محمد أصح هكذا ذكر. والمختار للفتوى أنها تطلق في الحكم لا في الديانة.
