    ٩٥ - نجيب بن عبد الله السمرقندى، أبو بكر. ذكره يحيى بن الصيرفى الحرانى الفقيه فى بعض تصانيفه، وقال: أظنه من تلامذة ابن عقيل.قال: وله تخاريج حسنة فى المذهب. وذكر من ذلك: أنه خرج رواية: أنه لا يجب القود فى صورة الإكراه على القتل إلا على المكره، ولا على المكره، من الرواية التى يقول فيها: لا تقتل الجماعة بالواحد؛ لامتزاج الأفعال، فكذلك هنا وأولى؛ لأن السبب غير صالح.
