    ١٥١٧ - الشيخ الفاضل الحسن بن مسهر *. روى عن محمد بن الحسن أنه قال: جواز أخذ أجرة الظئر دليل على فساد بيع لبنها؛ لأنه لما جازت الإجارة ثبت أن سبيله سبيل المنافع، وليس سبيله سبيل الأموال، لأنه لو كان مالًا لم تجز إجارته، ألا ترى أن رجلًا لو استأجر بقرة على أن يشرب لبنها لم تجز الإجارة. كذا رواه بمسنده عن الحسن بن مسهر، عن محمد بن الحسن، أبو الليث، في "الجامع الصغير". * * *
