    ٦٥١ - الشيخ الفاضل أحمد بن ناجِم *. روى عن نصير (¬١) بن يحيى، عن الحسن بن مُسْهِر عن محمد بن الحسن، أنه قال: جواز إجازة الظئر دليل على فساد بيع لبنها؛ لأنه لما جازت الإجارة ثبت أن سبيله سبيل المنافع، وليس سبيل الأموال، لأنه لو كان مالًا لم تجز إجارته، ألا ترى، لو أن رجلًا استأجر بقرة على أن يشرب لبنها لم تجزْ الإجازة. * * *
