Yahya related to me from Malik from Ibn Shihab from Haram ibn Sad ibn Muhayyisa that a female camel of al-Bara ibn Azib entered the garden of a man and it did some damage to it. The Messenger of Allah, (ﷺ), gave a judgement that the people of the garden were responsible for guarding it in the day, and the owner of the animals was liable for what the animals destroyed at night.
Al-Bara' had a she-camel which was accustomed to graze the standing crop belonging to the people. She entered a garden and did damage to it. The Messenger of Allah (ﷺ) was informed about it. So he gave decision that the owners of gardens are responsible for guarding them by day, and the owners of the animals are responsible for guarding them by night. Any damage done by animals during the night is a responsibility lying on their owners.
Ibn Muhayyisah Al-Ansari told him that a she-camel belonging to Bara used to wander free. It entered a garden belonging to some people and caused some damage. The Messenger of Allah (ﷺ) was told of that, and he ruled that property was to be protected by its owners of livestock were responsible for any damage caused by their animals during the night.
Al-Bara bin 'Azib (RAA) narrated, ‘The Messenger of Allah (ﷺ) ordained that the guarding of a garden is the responsibility of its owners during the day and the guarding of animals is the responsibility of their owners at night. However, the owners of the animals are responsible for any damage caused by their animals during the night (i.e. pay compensation for what they damaged of other’s property).’ Related by Ahmad and the four Imams except At-Tirmidhi. Ibn Hibban graded it as Sahih.
Haram b; Sa‘d b. Muhayyisa said that when a she-camel belonging to al-Bara’ b. ‘Azib entered a garden and did damage, God’s Messenger gave decision that the owners of gardens are responsible for guarding them by day, but that any damage done by animals during the night is a responsibility lying on their owners. Malik, Abu Dawud and Ibn Majah transmitted it.
