[١٠٠٨٨] قُتَيْبَةُ بْنُ سَعِيدِ بْنِ جَمِيلِ بْنِ طَرِيفِ بْنِ عَبْدِ اللَّهِ، الثَّقَفِيُّ، أَبُو رَجَاءٍ (¬٧) (¬٨). سمع اللَّيثَ، ومالكًا، وحمَّادَ بنَ زَيْدٍ، وأبا عَوانةَ (¬٩). ماتَ في (¬١٠) شعبانَ سَنَةَ أَربعينَ ومائتينِ (¬١١).

[٤٨٤١] (ع) عطاء بن يزيد الليثيّ، ثم الجُنْدَعيّ، أبو محمد (¬٣)، وقيل: أبو يزيد (¬٤)، المدنيّ، ثم الشاميّ (¬٥). روى عن: تَميم الدَّاريّ، وأبي هُريرة، وأبي سعيد الخُدريّ، وأبي أيوب الأنصاريّ، وحُمْران بن أَبان، وعُبيد الله بن عَدِي بن الخِيَار. وعنه: ابنه سليمان، والزُّهريّ، وأبو عُبيد - حاجب سليمان بن عبد الملك -، وأبو صالح السَّمَّان، وسُهيل بن أبي صالح، وهلال بن مَيمون الرَّمْلِيّ، وغيرُهم.قال عليّ بن المدينيّ: سكن الرَّملة، وكان ثقة (¬١) وقال النسائيّ: أبو يزيد عطاء بن يزيد شاميٌّ ثقةٌ. وقال ابن سعد: كِناني مِن أنفسهم، توفي سنة سبع ومئة، وهو ابن اثنتين وثمانين سنة، وهو كثيرُ الحديثِ (¬٢). وقال عمرو بن علي: مات سنة خمس ومئة (¬٣). وكذلك قال ابن حبان في "الثقات" (¬٤)، وزاد: وهو ابن ثمانين سنة (¬٥).

١٦١٨ - عَطاء بن يزيد الليثى من كنانة من أنفسهم يكنى أبا محمد، توفّى سنة سبع ومائة وهو ابن اثنتين وثمانين سنة. روى عن أيّوب، وتَمِيم الدَّارِى، وأبى هُريرة، وأبي سعيد الخُدرى، وعبيد الله بن عدىّ بن الخِيار، وروى عنه الزّهْرىّ. وكان كثير الحديث. * * *

That Al-Miqdad bin `Amr Al-Kindi, who was an ally of Bani Zuhra and one of those who fought the battle of Badr together with Allah's Messenger (ﷺ) told him that he said to Allah's Messenger (ﷺ) , "Suppose I met one of the infidels and we fought, and he struck one of my hands with his sword and cut it off and then took refuge in a tree and said, "I surrender to Allah (i.e. I have become a Muslim),' could I kill him, O Allah's Messenger (ﷺ) , after he had said this?" Allah's Messenger (ﷺ) said, "You should not kill him." Al- Miqdad said, "O Allah's Messenger (ﷺ) ! But he had cut off one of my two hands, and then he had uttered those words?" Allah's Messenger (ﷺ) replied, "You should not kill him, for if you kill him, he would be in your position where you had been before killing him, and you would be in his position where he had been before uttering those words."
An ally of Bani Zuhra who took part in the battle of Badr with the Prophet, that he said, "O Allah's Messenger (ﷺ) ! If I meet an unbeliever and we have a fight, and he strikes my hand with the sword and cuts it off, and then takes refuge from me under a tree, and says, 'I have surrendered to Allah (i.e. embraced Islam),' may I kill him after he has said so?" Allah's Messenger (ﷺ) said, "Do not kill him." Al- Miqdad said, "But O Allah's Messenger (ﷺ) ! He had chopped off one of my hands and he said that after he had cut it off. May I kill him?" The Prophet (ﷺ) said. "Do not kill him for if you kill him, he would be in the position in which you had been before you kill him, and you would be in the position in which he was before he said the sentence." The Prophet (ﷺ) also said to Al-Miqdad, "If a faithful believer conceals his faith (Islam) from the disbelievers, and then when he declares his Islam, you kill him, (you will be sinful). Remember that you were also concealing your faith (Islam) at Mecca before."
A person came to the Messenger of Allah (ﷺ) and said: Messenger of Allah, what do you think if a man comes to me in order to appropriate my possession? He (the Prophet) said: Don't surrender your possession to him. He (the inquirer) said: If he fights me? He (the Prophet) remarked: Then fight (with him). He (the inquirer) again said: What do you think if I am killed? He (the Prophet) observed: You would be a martyr. He (the inquirer) said: What do you think of him (Messenger of Allah) If I kill him. He (the Prophet) said: he would be in the Fire.
Al Miqdad bin Al Aswad reported that he said “Messenger of Allaah(ﷺ) tell me if I meet a man who is a disbeliever and he fights with me and cuts off one hand of mine with the sword and then takes refuge by a tree and says “I embraced Islam for Allah’s sake. Should I kill him, Messenger of Allaah(ﷺ) after he uttered it (the credo of Islam)? The Messenger of Allaah(ﷺ) said “Do not kill him”. I said “Messenger of Allaah(ﷺ), he cut off my hand. The Messenger of Allaah(ﷺ) said, Do not kill him. I f you kill him, he will become like you before you kill him and you will become like him before he uttered his credo which he has uttered now.
"O Messenger of Allah, this man killed my brother." The Messenger of Allah said to him: "Did you kill him?" He said: "O Messenger of Allah even if he did not confess I would have brought proof against him." He said: "Yes, I killed him." He said: "How did you kill him?" He said: "He and I were chopping firewood from a tree and he insulted me, so I got angry and struck him with the ax on the forehead." The Messenger of Allah said: "Do you have any wealth with which you can pay the Diyah to save yourself?" He said: "O Messenger of Allah, I do not have anything but my ax and my clothes." The Messenger of Allah said to him: "Do you think your people will pay to save you?" He said: "I am too insignificant to them for that." He threw the string to the man and said: "Here, thank him." When he turned to go, the Messenger of Allah said: "If he kills him, he will be like him. "They caught up with the man, and said: "Woe to you! The Messenger of Allah said: 'If he kills him, he will be like him. "So he went back to the Messenger of Allah and said: "O Messenger of Allah, I have been told that you said: 'if he kills him, he will be like him. 'But I only took him because you told me to. He said: 'Don't you want him to carry your sin and the sin of your companion (the victim)?' He said: 'Yes, if that is the case.' He said: 'And that is how it is."'
I said, "Tell me, O Messenger of Allah, if I meet an infidel, and we fight together, and he cuts off my hands with his sword, then hides from me behind a tree and (then) says he has submitted himself to Allah. Shall I kill him after he has said it?" He (ﷺ) replied, "Do not kill him." I submitted, "But O Messenger of Allah, he cut off one of my hands and only then he said it." Messenger of Allah (ﷺ) then replied, "Do not kill him, for if you do so, he will be in the position in which you were before you killed him (i.e., he will be considered a Muslim and thus his life will be inviolable), and you will be in the position in which he was before he made his testimony (i.e., your life will not be inviolable, for his heirs can ask for Qisas)". <b>[Al-Bukhari and Muslim]</b>.
