Riyad as-Salihin, 574

'Abdullah bin 'Umar (May Allah be pleased with them) reported:

Messenger of Allah (ﷺ) said, "It is the duty of a Muslim who has something which is to be given as a bequest not to have it for two nights without executing a written will." <b>[Al-Bukhari and Muslim]</b>. In the narration of Muslim it is narrated as 'three nights'. Ibn 'Umar (May Allah be pleased with them) said: Since I heard the Messenger of Allah say this, I have never spent a night without having my will with me.

وعنه أن رسول الله صلى الله عليه وسلم قال‏:‏ “ ما حق امرئ مسلم ، له شئ يوصي فيه ، يبيت ليلتين إلا ووصيته مكتوبة عنده” ‏(‏‏(‏متفق عليه‏)‏‏)‏ هذا لفظ البخاري‏.‏ وفى رواية لمسلم” يبيت ثلاث ليال‏:‏ قال ابن عمر‏:‏ ما مرت على ليلة منذ سمعت رسول الله صلى الله عليه وسلم قال ذلك إلا وعندي وصيتي‏.‏

<b>Guidance from the Hadith:</b><br> 1) We are encouraged to write a will, and the testator should know the Shariah rulings regarding the will in order not to err in this regard.<br> 2) We should pay attention to the matter of the will, as death may come suddenly, in which case the person who ignored to write his will would incur sin and cause loss of others’ rights.<br> 3) It points out how the Companions (may Allah be pleased with them) would quickly comply with the Prophet’s commands. This is the attitude of the believers: We listen and obey.<br> <br> <b>Benefit:</b><br> Types of wills:<br> 1. Due will: This is when a person makes a will that includes rights due upon him, like Zakah, debts, deposits, or trusts, provided none of them contradicts the Shariah.<br> 2. Prohibited will: It is of two types:<br> a. When a person makes a bequest for one of his heirs beyond their due share of inheritance. The Prophet (may Allah’s peace and blessings be upon him) said: “Allah has appointed for everyone who has a right what is due to him, so no bequest should be made for an heir.” [Narrated by Al-Tirmidhi]<br> b. When the will exceeds one third of the estate, at the expense of the rights of the heirs. The Prophet (may Allah’s peace and blessings be upon him) forbade that a will exceeds one third of the estate.<br> 3. Permissible will: This is when the will does not comprise the foregoing and does not exceed one third. The Prophet (may Allah’s peace and blessings be upon him) said: “A third, and a third is much.” [Narrated by Al-Bukhāri and Muslim]
