١٠٢٦ - سعيد بن جبير الأسدي قال ابن هانئ: وسمعته يقول: كان سعيد بن جبير كاتبا لعبد اللَّه بن عتبة. "مسائل ابن هانئ" (٢٣٨٧)قال المروذي: وذُكر له مجاهد وسعيد بن جبير أن الأعمش يَروي عنهما، فقال: نعم. "العلل" رواية المروذي وغيره (١) وقال عبد اللَّه: حدثني أبي قال: حدثنا هشيم عن أبي بشر قال: قال سعيد بن جبير: ليقتلني الحجاج، قال: قلت: كيف علمت ذاك؟ قال: رؤيا رأيتها. ٤٦٨ - [سعيد بن جبير] (١) سعيد بن جبير بن هشام أبو عبد الله الكوفي الأسدي الوالبي، مولى بني والبة بن الحارث من أسد خزيمة. سمع ابن عباس وابن عمر وابن الزبير، وغيرهم من الصحابة والتابعين. وروى عنه جمع من التابعين، وكان من كبار أئمة التابعين ومتقدميهم في التفسير والحديث والفقه والعبادة والورع، وغيرها من صفات أهل الخير. حدث بحضرة شيخه ابن عباس بأمره، وكان ابن عباس إذا أتاه أهل الكوفة يسألونه .. فيقول: أليس فيكم سعيد بن جبير؟ ! روي: أنه قرأ القرآن في ركعة في البيت الحرام، وأنه كان له ديك يقوم من الليل بصياحه، فلم يصح ليلة حتى أصبح، فلم يصل سعيد تلك الليلة ورده، فشق عليه ذلك، فقال: قطع الله صوته؛ فما سمع له صوت بعده. قتله الحجاج صبرا ظلما في شعبان من سنة خمس وتسعين، فلم يعش الحجاج بعده إلا أياما، ومات في أواخر رمضان، ولما قتله .. سال منه دم كثير أكثر مما يسال من دم غيره ممن قتله الحجاج، فسأل الحجاج الأطباء عن ذلك فقالوا: هذا قتلته ونفسه معه، والدم يتبع النفس، وغيره قتلتهم وأنفسهم ذاهبة من الخوف؛ فلذلك قلّ دمهم. ويقال: إن الحجاج كان في مدة مرضه يرى سعيد بن جبير آخذا بمجامع ثوبه ويقول له: يا عدو الله فيم قتلتني؟ فيستيقظ مذعورا ويقول: ما لي ولسعيد بن جبير؟ ! وعمر سعيد بن جبير يوم قتل تسع وأربعون سنة.

"العلل" رواية عبد اللَّه (2981)، (2982) وقال عبد اللَّه: سألت أبي عن سعيد بن جبير سمع من عدي بن حاتم؟ قال: ينبغي أن يكون سمع منه، الشعبي سمع منه، يقول: حدثنا عدي ابن حاتم. One of you two is a liar, and you (the husband) have no right over her (she is divorced)." The man said, 'What about my property (Mahr) ?' The Prophet (ﷺ) said, 'You have no right to get back your property. If you have told the truth about her then your property was for the consummation of your marriage with her; and if you told a lie about her, then you are less rightful to get your property back.' " Sufyan, a sub-narrator said: I learned the Hadith from `Amr. Narrated Aiyub: I heard Sa`id bin Jubair saying, "I asked Ibn `Umar, 'If a man (accuses his wife for an illegal sexual intercourse and) carries out the process of Lian (what will happen)?' Ibn `Umar set two of his fingers apart. (Sufyan set his index finger and middle finger apart.) Ibn `Umar said, 'The Prophet (ﷺ) separated the couple of Bani Al-Ajlan by divorce and said thrice, "Allah knows that one of you two is a liar; so will one of you repent (to Allah)?' "
The Prophet (ﷺ) said to those who were involved in a case of Lian, "Your accounts are with Allah. One of you two is a liar. You (husband) have right on her (wife)." The husband said, "My money, O Allah's Messenger (ﷺ) !" The Prophet (ﷺ) said, "You are not entitled to take back any money. If you have told the truth, the Mahr that you paid, was for having sexual relations with her lawfully; and if you are a liar, then you are less entitled to get it back."
Your account is with Allah. One of you must be a liar. You have now no right over this woman. He said: Messenger of Allah, what about my wealth (dower that I paid her at the time of marriage)? He said: You have no claim to wealth. If you tell the truth, it (dower) is the recompense for your having had the right to intercourse with her, and if you tell a lie against her, it is still more remote from you than she is. Zuhair said in his narration: Sufyan reported to us on the authority of 'Amr that he had heard Sa'id b Jubair saying: I heard Ibn Umar (Allah be pleased with them) saying that Allah's Messenger (ﷺ) had said it.
"I heard Sa'eed bin Jubair say: 'I was asked about the two who engage in Li'an during the governorship of Ibn Az-Zubair - should they be separated? I did not know what to say, so I got up and went to the house of Ibn 'Umar and said: "O Abu 'Abdur-Rahman, should the two who engage in Li'an be separated?" He said: "Yes, Subhan Allah! The first one who asked about that was so-and-so the son of so-and-so who said: 'O Messenger of Allah, what do you think if a man among us sees his wife committing immoral actions, and if he speaks of it, he will be speaking of a grave matter, but if he keeps quiet, he will be keeping quiet about a grave matter?' He did not answer him, then after that, he came to him and said: 'I was tried with the matter that I asked you about, so Allah, the Mighty and Sublime, revealed these Verses in Surat An-Nur.: 'And for those who accuse their wives' until he reached: 'And the fifth (testimony) should be that the Wrath of Allah be upon her if he (her husband) speaks the truth.' So he started with the man, exhorting him, reminding him, and telling him that the punishment in this world was less severe than the punishment in the Hereafter. He said: 'By the One Who sent you with the truth, I am not lying.' Then he turned to the woman and exhorted her and reminded her. She said: 'By the One Who sent you with the truth, he is lying.' So he started with the man, and he bore witness four times by Allah that he was telling the truth, and the fifth time (he invoked) the curse of Allah upon himself if he was lying. Then he turned to the woman and she bore witness four times by Allah that he was lying, and the fifth time (she invoked) the wrath of Allah upon herself if he was telling the truth. Then he separated them."'"
"I said to Ibn 'Umar: 'A man accused his wife.' He said: 'The Messenger of Allah separated the couple from Banu 'Ajlan and said: Allah knows that one of you is lying, so will either of you repent? He said that to them three times and they did not respond, then he separated them.'" (One of the narrators) Ayyub said: "Amr bin Dinar said: 'In this Hadith there is something that I think you are not narrating.' He said: 'The man said: My wealth. He said: You are not entitled to any wealth. If you are telling the truth, you have consummated the marriage with her, and if you are lying then you are even less entitled to it.'"
